Nyali School Parents Clash with Trustees Over Crucial Documents Amid Management Dispute

Angry Nyali School parents have crossed swords with the management over their demands for transparency and key documents from the Board of Trustees in relation to the saga. The row climaxed outside a Mombasa church where parents had camped, waiting for the embattled chairman, who is reported to have left in a different vehicle to avoid the confrontation.

Angry Parents Confront School

One parent, Kelvin Opiyo, said the trustees have dodged accounting for many years by over-staying in their positions. We don’t know where the documents of Nyali school are, if the school was sold, or used as security for a loan. The trustees are not forthcoming with information,” said Opiyo.

Parents have been seeking important documents from the management but their efforts were met with silence as the trustees have refused to commit to their demands. Opiyo further highlighted the confusion and distress caused by lack of transparency; students had missed three weeks of school due to the management dispute at the time.

“We don’t understand why the trustees want to continue running the school when there is a Board we elected,” Opiyo added, asking the Chairman to hand over the documents.

Call for Intervention

Doroso Okemba is another parent concerned enough to call for the intervention of the church in the hope that an amicable resolution will be reached; a resolution that recognizes concerns of the aggrieved parents. The call for intervention from an external party speaks volumes about the level of desperation from parents in as far as wanting a clear solution to the impasse.

Court Battles and Disruptions

The dispute was heard early this year when parents went to court to remove the outgoing officials, saying the school’s day-to-day running was marred by endless wrangles. This led to a petition in the Mombasa High Court to stop the newly elected officials from taking office.

In a May 23, 2024 ruling, Justice Olga Sewe granted Conservatory Order suspending the assumption of office by the newly elected Board and requiring that the election dispute to be resolved through arbitration in accordance with provisions of the school’s constitution, while the outgoing management was asked to continue running the operations of the Institution.

Pending hearing and determination of the petition, a Conservatory Order suspending the Assumption of Office of the newly elected management Board of Mombasa Parents Club School is hereby issued,” the court order read. According to Justice Sewe, arbitration must be done in a manner consistent with the school’s constitution so that it is not in either breach or violation of the laws.
