TSC Halts KUPPET Branch Benevolent Fund Deductions Amid Legal Challenge

The Teachers Service Commission (TSC) has stopped deducting money from members of the Kenya Union of Post Primary Education Teachers (KUPPET) meant for the Branch Benevolent Fund (BBF). The decision came after five officials from KUPPET lodged a petition questioning the legality for making these deductions.

The petition referenced as Constitutional Petition No. E008/2024, was brought to the Employment and Labor Relations Court through branch executive secretaries Paul Kipchumba Rotich, William Lengoiyap, Robert Miano, Peter Oluoch and Jentrix Ogola.

In the letter from TSC dated on May 21, 2024 and signed by Cavin Anyuor who serves as the Commission’s Director for Legal and Industrial Relations on behalf of CEO Dr. Nancy Macharia notes that the Ethics and Anti-Corruption Commission were also involved into this matter of deductions.

The deductions in question were first allowed through a decision made by KUPPET delegates at their yearly conference on April 3rd, 2021; it was then sent to TSC with an official letter dated May 17th of same year communicating this decision. Following concerns expressed by the petitioning officials, TSC has chosen to stop all BBF-related deductions right away.
